An option agreement gives a producer the exclusive right, for a defined period and fee, to acquire rights to a property such as a book or script. If the option is exercised, a separate purchase agreement governs the transfer.
What rights does a producer need to make a film?
Underlying rights to the source material, talent and performer agreements with releases, music clearances, location releases, and clearance for any third-party material appearing on screen. Distributors and insurers require documentation of all of it.
What is E&O insurance and why do distributors require it?
Errors and omissions insurance covers claims arising from the content, such as infringement, defamation, or privacy violations. Distributors require it, and insurers require completed rights clearance before issuing it.
What's the difference between scripted and unscripted rights work?
Scripted projects center on underlying literary rights and writer agreements. Unscripted projects center on participant agreements, releases, life rights, and location and clearance issues arising from filming real people and places.
